A Lagos Federal High Court, at the weekend, struck out an application seeking to stop an election of the Nigerian Football Federation, NNF, filed by the Registered Trustees of the National Association of Nigerian Footballers, NANF.
The court presided over by Justice Okon E. Abang, struck out the case following the absence of the counsel to NANF, Mr. Belo Aideloje, at the Friday’s proceeding of the suit.
Joined as defendants in the suit were Nigerian Football Association, Alhaji Aminu Maigari, Nigerian Premier League Board, as first, second, third and fourth defendants.
While Mr. Davidson Owumi, the president, Nigerian Premier league, the Minister of Sports, the Director General of Sports, the electoral Committee, NFA, and A. U. Mustapha, as fifth, sixth and seventh defendants.
At the Friday’s proceeding, one of the court’s registrars informed the court that counsel to the Registered Trustees, Mr. Aideloje sent a letter seeking for an adjournment to a later date in July, due to Ekiti state governorship election scheduled for June 21 ,2014, which he stated he is to monitored.
However, Chief Akin Olujimi, SAN, counsel to the first, second, seventh and eight respondents, vehemently opposed to the adjournment application and urged the court to dismiss the application, and also asked for a cost of N500, 000, 00.
Chief Olujimi told the court he was not served with a copy of the application for adjournment; and that informed that the applicant’s counsel did not have the courtesy to serve him with the copy of the letter.
Justice Abang, while delivering a verdict on the application for adjournment held that “granting or refusing an application for ban adjournment in a matter stated for hearing before the court is at the court’s discretion. The court is enjoined to exercise discretion both judiciously; considering the application judiciously and considering the fact of the case.
